8 years agoA Saskatchewan man launches an online gaming site, Dani Mario reports.1:05A Saskatchewan First Nations man who played a key role in the expansion of gambling in the province has just started his own online casino.
Bernie Shepherd, former chief of the White Bear First Nation in the southeast part of the province, launched Northern Bear online casino on Tuesday morning.
Although it's being done without the approval of the provincial government, Shepherd says he's exercising his inherent treaty rights as a First Nations person.
He added that, in his view, the nature of the internet is such that it should be possible for almost anyone to create an online gambling site.
'There's lots of casinos online,' Shepherd told Craig Lederhouse of CBC Radio's The Afternoon Edition on Tuesday. 'If you wanted to start a casino, you can start a casino. You just have to have the where-with-all to do it. So it's not illegal to own an online casino.'
Shepherd's site uses servers in the Virgin Islands.
The province says it's reviewing all of this, and it has notified the RCMP.
Operating out of an office on the reserve, Shepherd, described as the CEO and owner of the casino, said he's doing essentially the same thing he did in the early 1990s when, as chief of White Bear, he was instrumental in setting up a bricks-and-mortar casino on the reserve.
The RCMP raided that facility, but in the months that followed, the government and Saskatchewan First Nations hammered out a historic gambling agreement.
Today, there are six First Nations-run casinos in the province that generate millions of dollars of profits every year, money that goes to First Nations and the provincial government.
CBC News also learned that while Shepherd is the operator of the casino, he is associated with another online business called GeoBet which uses facilities in the Virgin Islands. However, the form of that association is not entirely clear as GeoBet is licensed by an online gaming authority on a First Nation in Quebec. According to an official, the latest venture falls outside their licensing rules.
Online gambling is a new frontier for Saskatchewan.
On Monday, Donna Harpauer, the minister responsible for the Saskatchewan Liquor and Gaming Authority, said the province will not proceed with online gambling because the risks outweigh the benefits. Government officials had previously raised concerns about problem gambling online.
Asked about Shepherd's operation, Harpauer said there are a number of legal questions and the government will be keeping an eye on it.

University of Saskatchewan law professor Norman Zlotkin says despite what the province is saying, he thinks an agreement in the cards, perhaps sooner rather than later.
'At some point in the relatively near future we'll have online gaming in the province,' he said. 'Online gaming brings money into the provincial treasury and it helps the First Nations.'
The Federation of Saskatchewan Indian Nations wasn't commenting earlier this week, while the Saskatchewan Indian Gaming Authority, which is responsible for the First Nations run casinos, says it is watching to see how things play out.
If the government tries to crack down on the new online casino, it might not be simple, according to Montreal's Cookie Lazarus, an expert in gambling law, who notes that First Nations in Quebec have been running online gambling for years.
It's hard to take action against online operators as long as the business is conducted in cyberspace, he said.

'Eventually Saskatchewan will be unable to prevent online gaming from occurring within their territory,' he said.
Lazarus added it's still a legal grey area for First Nations that want to start online casinos, because it has not been tested in court.
